Some information about you is also collected automatically from your device (e.g., IP address, internet provider, operating system and browser used, domain names of the computers you use to visit our Site, type of device, such as laptop or smart phone, log files, Uniform Resource Identifiers of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in reply, the numerical status code of the server reply and other parameters concerning the user's operating system and computer environment, and/or device cookie settings and other device details, such as MAC address).  And some information about you is also collected automatically from your internet browser (e.g., browser type, operating system type or mobile device model, viewed webpages, links that are clicked, the keystrokes typed, movement of the mouse or pointer, IP address, mobile device identifier or other unique identifier, sites or apps visited before coming to our Site, the amount of time you spend viewing or using the Site and the pages visited, the number of times you return, or other click-stream or site usage data, and emails we send that you open, forward, or click through to our Site).

3. How We Use the Information We Collect

We use your information to perform all management activities connected with your order, including administrative management of the contract, delivery of goods, management of any claims and litigation, and to validate, confirm, verify, deliver, install, and track your order; and to send you information related to products and services, including catalogs, promotions, rewards, upcoming events, invoices, technical notices, updates, security alerts, and support and administrative messages.

We use the information obtained when you contact us through the "Contact Us" link to process your suggestion or customer service request; to respond to your requests; and to manage your relationship with us.

We may from time to time contract with third parties who place information, or other promotional material or links on our site. If you click on a link provided by a third party and leave our site, whether through a link or through visiting another Web site framed within our Site, you are subject to the privacy policies of these third parties. We do not have responsibility for or access to the information collected by these third parties.

6. Our Commitment to Data Security

The security of all information associated with our users is an important concern to us. We exercise care in providing secure transmission of your information from your computer to our servers. No sensitive data is stored in the pages directly. We have administrative, technical, and physical safeguards in place to protect your personal information once it reaches us. However, "perfect security" does not exist on the Internet, therefore you transmit information to us at your own risk.

Persistent cookies tell us if you have visited the Site before or if you are a new visitor.  Third-party cookies are installed by third parties and collect information from users of the Site to serve advertising marketed towards a specific target audience or to carry out research into behavior, demographics, or spending habits.

Most browsers automatically accept cookies. You can disable this function but disabling cookies may impact your use and enjoyment of the Site.

Similarly, we use tracking web beacons to track use of the websites.  A “web beacon,” also known as an Internet tag, pixel tag or clear GIF, is used to transmit information back to a web server.  We may also employ session replay software on our Site.  We, our service providers, and our business partners may collect information about individuals’ online activities over time and across third-party websites when an individual uses our Site.

8. Do-Not-Track Signal

We currently do not honor “Do-Not-Track” signals from your browser.

9. Information for Site Visitors and Business Contacts from California

We provide a business-to-business service.  If you are a California resident and we receive your personal information in any of the ways included above, we may use your personal information and business details as described in this Policy.  California law provides you with the following rights with respect to your personal information, subject to certain limitations:

  • The right to know what personal information we have collected, used, or disclosed about you.
  • The right to request that we delete any personal information we have collected about you.
  • The right to correct inaccurate personal information about you.
  • The right to opt out of the selling or sharing of your personal information, which you can exercise as described below or by modifying your privacy preferences (e.g., Global Privacy Control), available through certain internet browsers and extensions, that signal your preference to opt out.  Please note that clearing your cookies at any time will remove the signal of your selected privacy preferences.

In addition, and as set forth below, California law requires us to identify, for the 12-month period prior to the date of this Policy, what information we may have “sold” or “shared” about you. For the 12-month period prior to the date of this Policy, we have not sold your personal information. For the 12-month period prior to the date of this Policy, we have only shared personal information as described above.  We do not use or disclose sensitive personal information, as defined in applicable laws, for any purposes other than those permitted by applicable law.

Opt-Out Preference Signals:  We are working towards enabling Global Privacy Control (GPC) as an additional way for you to submit a request to opt out of the sale and sharing of your personal information through browsers and/or browser extensions that support such a signal.  Until then, you can opt out of the use of third-party cookies for personalized advertising by setting your cookie preferences on your browser.

When you exercise these rights and submit a request to us, we will verify your identity  by asking you to provide us with additional information such as your email address, order numbers of previous orders of our products and services, or the last four digits of a credit or debit card used to make a purchase.  We also may use a third-party verification provider to verify your identity. We will endeavor to honor such requests unless such a request conflicts with certain lawful exemptions under California’s consumer privacy law. Please note that your exercise of these choices is subject to certain exemptions to safeguard the public interest (e.g., the prevention or detection of crime) and our interests (e.g., the maintenance of legal privilege).  

Authorized Agent:

California consumers may use an authorized agent on their behalf to exercise a privacy choice discussed above. If you are an authorized agent acting on behalf of a California consumer to communicate with us or to exercise a privacy choice discussed above, you must be able to demonstrate that you have the requisite authorization to act on behalf of the resident and have sufficient access to their laptop, desktop, or mobile device to exercise these choices digitally. If you are an authorized agent trying to exercise choices on behalf of a Heritage Pool Supply Group user, please contact us using the information below with supporting verification information, which includes a valid Power of Attorney in the State of California, proof that you have access to the consumer’s interface, and proof of your own identity.

Non-Discrimination:

We do not discriminate against California residents who exercise any of their rights described in our Privacy Policy. Your exercise of these rights will have no adverse effect on the price and quality of our goods or services.

Record Retention:

We may retain your personal information for as long as necessary to fulfil the purpose for which it was collected or to comply with legal or regulatory requirements.
